The following factors must be considered in vacation determinations. Decisions to vacate streets or alleys are entirely within Council’s sole and absolute discretion. Council may deny a petition that addresses all of the following factors, but may not grant a vacation petition without adopting findings that show how the proposed vacation does or does not address each of the following factors:

A. Whether a change of use or vacation of the street or alley will provide a significant benefit to the public;

B. Whether the street or alley is neither currently required for public use or public access nor anticipated to be needed for public use or access in the future;

C. Whether the substitution of a new and different public way would be more useful to the public;

D. Whether possible future public uses may require the right-of-way; and

E. Whether objections to the proposed vacation are made. (Ord. 3052 § 1 (Exh. A), 2020)
