A. It is unlawful to construct, place, maintain, or operate any pipes, ducts, utility tunnels, vaults, maintenance holes, poles, fixtures, wires, utility facilities, wireless facilities, or any other appurtenances necessary for the purpose of providing wireless service, or to conduct any public utility business, on, over, or under the public right-of-way, without obtaining a master permit from the Council.

B. It is unlawful to construct, repair, or maintain any pipes, ducts, utility tunnels, vaults, maintenance holes, poles, fixtures, wires, utility facilities, wireless facilities, or any other appurtenances necessary for the purpose of providing wireless service, or to conduct any public utility business or to go upon any such public right-of-way to perform any work therein on, under, or over the public right-of-way, without obtaining a construction permit from the City Engineer. The City Engineer may exempt certain activities from the requirements of this section that do not materially affect the public right-of-way; provided, however, that if the City Engineer denies an applicant’s request for such an exemption, no appeal is permitted.
