It is declared to be necessary for the protection of the health of the public of the city that all owners of property situated in said city which can be served as hereafter provided by the sanitary sewage system, be and they are required and shall be compelled to connect their sanitary drains and sewers with said sanitary sewage system, and it is unlawful for any property owner to fail or refuse to make such connections. The owner of each lot or parcel of real property within the city not already connected to the sanitary sewage system of said city, upon which lot or parcel of property there is now situated any building or structure for human occupation, any part of the foundation of which is within two hundred feet of a public sewer, shall install suitable toilet facilities within such structure and shall connect such facilities, together with all other facilities therein the use of which results in the existence of sewage, with the sanitary sewage system, at his own expense within six months after the adoption of a resolution by the city council signifying acceptance of the sanitary sewage system by the city from the contractors. The owner of each lot or parcel of real property within the city not already connected to the sanitary sewage system of said city, upon which lot or parcel of property there is hereafter constructed any building or structure for human occupation or use, any part of the foundation of which is within two hundred feet of a public sewer, shall connect such facilities therein the use of which results in the existence of sewage, with the sanitary sewage system, at his own expense, before occupancy thereof; provided, that the provisions of this section shall not apply where the only available sewer is at a depth at which connection cannot be made. This section shall not apply to any lot or parcel of property where there is now situated any building or structure for human occupation which is presently served by a properly functioning septic system meeting all state, county and city health standards. Should said septic system fail and no longer meet state, county and city health standards, the owner of said property shall connect to the Anacortes sewer system as provided in this section.
