The fact that a dangerous dog or potentially dangerous dog has not been declared as such under this chapter or similar laws in other jurisdictions shall not excuse noncompliance with the provisions of this chapter or provide a defense in any prosecution hereunder where the owner knew or should have known that the dog was a dangerous dog or potentially dangerous dog as defined in this chapter.
