A. Any industrial user who is found to have violated an order of the city council or who has wilfully or negligently failed to comply with any provision of this chapter and the regulations or rules issued hereunder shall be liable to the city for a civil penalty. The amount of such civil penalty shall not be less than two hundred fifty dollars per violation nor more than one thousand dollars per violation. Each day upon which a violation occurs or continues shall constitute a separate violation. Such penalties may be recovered by judicial actions and to the extent permissible by state law.

B. In addition to the penalties in this section, the city may recover reasonable attorney’s fees, court costs, court reporter’s fees, and other expenses of litigation by appropriate suit at law against the person found to have violated this chapter or the orders, rules, and regulations issued hereunder.
